Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the LeanPBX cloud communications platform and related services (the "Services"). This AUP is incorporated into and forms part of our Terms of Service. By using the Services, you agree to comply with this AUP. We may update this AUP at any time by posting the revised version on our website.

1. General Prohibited Activities

You may not use the Services to:

  • Violate any applicable local, state, national, or international law, regulation, or governmental order.
  • Engage in any fraudulent, deceptive, or misleading activity.
  • Transmit content that is threatening, harassing, defamatory, obscene, or otherwise objectionable.
  • Infringe upon the intellectual property rights, privacy rights, or other rights of any third party.
  • Transmit viruses, malware, ransomware, or any other malicious or harmful code.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services, our network, other customers' accounts, or any connected systems.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services.
  • Circumvent or attempt to circumvent any security measures, access controls, or usage limits of the Services.
  • Resell, sublicense, or redistribute the Services to third parties without our prior written consent.
  • Use the Services for any high-risk application where failure could result in personal injury, death, or significant property damage, unless adequate fail-safe mechanisms are independently maintained.
  • Exploit the Services or any minor in any way, including collecting personally identifiable information from minors without verifiable parental consent.

2. Voice and Telephony Restrictions

You may not use the voice or telephony features of the Services to:

  • Robocalling and Auto-Dialing: Engage in auto-dialing, predictive dialing, or robocalling in violation of the Telephone Consumer Protection Act (TCPA) or applicable state and federal regulations.
  • Caller ID Spoofing: Falsify, manipulate, or misrepresent caller ID information, or use any technical means to disguise the origin or identity of calls, in violation of the Truth in Caller ID Act or applicable FCC rules.
  • Spam Calls: Make bulk unsolicited calls for commercial purposes without the prior express consent of the called party.
  • Traffic Pumping: Engage in traffic pumping, access stimulation, or similar schemes designed to artificially inflate call volumes.
  • Call Recording Violations: Record calls without complying with applicable federal and state consent laws. See our Terms of Service Section 5 for call recording requirements.

3. SMS and Messaging Restrictions

You may not use the SMS or messaging features of the Services to:

  • Send messages without obtaining prior express written consent from recipients as required by the TCPA and CTIA guidelines.
  • Send marketing or promotional messages without providing clear opt-out instructions and honoring all opt-out requests promptly.
  • Use purchased, rented, or third-party contact lists for messaging campaigns.
  • Send messages that fail to identify you as the sender.
  • Engage in snowshoeing (spreading messages across multiple numbers to evade detection) or other anti-spam evasion techniques.

3.1 Prohibited Message Content

The following types of messaging campaigns are strictly prohibited:

  • Loan, mortgage, or payday loan advertisements.
  • Debt collection, credit repair, or debt relief offers.
  • Pharmaceutical, supplement, or controlled substance promotions.
  • Gambling, sweepstakes, or lottery promotions.
  • Cannabis or controlled substance sales or promotion.
  • Multi-level marketing or work-from-home scheme promotions.
  • Political campaign messages sent without proper consent and disclosure.
  • Adult or sexually explicit content.
  • Content promoting illegal activity, violence, or hate speech.
  • Third-party lead generation or affiliate marketing via SMS.

4. Network and Security

You may not:

  • Probe, scan, or test the vulnerability of our systems or networks without prior written authorization.
  • Attempt to intercept, monitor, or tamper with communications not intended for you.
  • Engage in denial-of-service attacks or any activity that degrades the availability or performance of the Services for other customers.
  • Use the Services to operate or facilitate the operation of any unauthorized relay, proxy, or similar service.

5. Enforcement

We reserve the right to investigate any suspected violation of this AUP. If we determine, in our sole discretion, that a violation has occurred, we may take one or more of the following actions without prior notice:

  • Issue a warning.
  • Suspend or restrict your access to the Services.
  • Terminate your account.
  • Remove or disable content that violates this AUP.
  • Report the violation to law enforcement or regulatory authorities.

We may also cooperate with law enforcement or regulatory authorities in investigating and prosecuting violations of this AUP. You remain responsible for all fees incurred during any suspension period.

If you become aware of any violation of this AUP, please report it to support@leanpbx.com.
